What Are the Sources of Conflict - 821 Words
1. What are the sources of conflict in this case? The source of conflict in this case is a disagreement about the way the business within the company is organized, changed by the emergence of new senior manager Mike Roth. Before the appearance of conflict situation the EPI (Educational Pension Investments) was conservative and adhered to steady and safe investments. With the coming of Mike the situation completely changed. Actually he undermined the whole image and philosophy of the company. Mike completely changed the investment policy, made it more aggressive, which resulted in higher ROI (return on investment). However higher ROI entails higher risk. Thatââ¬â¢s the point where the old senior managers had a contradiction with theâ⬠¦show more contentâ⬠¦To solve such problems parties should meet face to face. The third conflict approach was the avoidance response when the talk between Mike and Dan was postponed to the evening. As we noted before maybe this approach will help to solve a conflict. 3. Based on the behavioral guidelines for the collaborative approach, how could Dan have managed this conflict more effectively? First of all we want to identify that every company has its own corporate culture and unwritten rules. Every new hired employee is facing with problems and there will be for the first time misunderstandings of some employees. In MNC or TNC companies employees are facing with problem as ââ¬Å"culture shockâ⬠. When employee was hired he will feel as honeymoon period then will be a disappointment period. After this period begins adaptation and at the end double culture employee. We assume that Mike cannot fit into the unwritten rules of company. As we noted before, itââ¬â¢s normal for the first time. But if the conflict continues for a long time managers should to take action and that the Dan Richardson the CEO of EPI is trying to do in this case. But the result is not productive. In our opinion after the third approach ââ¬â avoidance approach, m aybe they can avoid this conflict. Gap in time or pause is sometimes necessary in such cases. Both sides can realize their mistakes. Mike may withdraw from his intention for some time. Elderly in American and Vietnamese Culture free essay sample
According to the survey conducted in 2009, nine-in-ten elderly have their own home or apartment. In another survey, 42. 3 million of 42. 3 million Americans age 65 and older say that its easy for them to cover their monthly living expenses. Itââ¬â¢s clear that old Americans are able to support themselves without depending on anyone. However, even if they cannot take care of themselves, the old American people donââ¬â¢t have to worry because, in sense of health service or nursing houses, the American society and government seriously take good care of their senior citizens. There are more than 16,000 nursing houses for old people all over America, many of these houses has reached the 5-stars standard. The United States is famous for spending more on health care for seniors more than any other developed country on the world (Americaââ¬â¢s seniors, 2012). Moreover, beside health care, tons of money is also being invested in medical researches (95 billion in 2005). The seniors, of course, gain benefit from that investment. Rate of heart disease ââ¬â the most common disease among old Americans- has declined by a third since 1980 thanks to many breakthroughs in medical field. The vast majority of old American people considered themselves healthy when being asked about health condition (Haya El Nasser, ââ¬Å"Lifes just goodâ⬠) In contrast to the Americans, the olds in Vietnamese seem to be not so lucky with the so called ââ¬Ëliving conditionââ¬â¢. A national survey conducted by the Vietnamese Ministry of Health Portal in 2011 pointed out that 60% of old people in Vietnam live in poverty. It is even worse in health care aspect with only 5% of old Vietnamese people confirm that they are in good health condition. While 21% of old American suffers serious illness, the percentage is nearly 95% in Vietnam. Itââ¬â¢s not because the government doesnââ¬â¢t care about the senior citizens but there is a lack of money and facilities to so. In Vietnam, poverty and poor health care service seem to be not only the problem of the old but also the young, the middle-ages and even the kids. There is still such a long way to go for the Vietnamese to improve the living standard and medical care for old people in Vietnam. However, ââ¬Ëthe richerââ¬â¢ doesnââ¬â¢t always mean ââ¬Ëthe happierââ¬â¢. When a person grows old in Vietnam, usually family and friends care for him or her at home until the end. In America, the elderly are more typically sent to nursing homes (Judy Lin, ââ¬Å"Honor or abandonâ⬠). Government programs could provide money or 5-stars health care service but these things can hardly a substitute for a caring, loving family. According to the survey conducted by Pew Research Center, there are more than 66% of old people in America live alone. Moreover, 43% reported that they are lonely. Jared Diamond, Pulitzer Prize winning author of ââ¬Å"Guns, Germs, and Steel said that: ââ¬Å"Many societies treat their elderly much better than Americansââ¬â¢. Most old people in American are not respected and left at the nursing houses (Laura K. Egendorf, ââ¬Å"Opposing Viewpointsâ⬠) The situation was not always that bad. In the 17th and 18th centuries, Americanââ¬â¢s attitudes toward the elderly were more positive. The seniors used to be highly respected; they were given the best seats in church, and Puritan teachings instructed youth on how to behave toward their elders (Laura K. Egendorf, ââ¬Å"Opposing Viewpointsâ⬠)). At that time, old people were respected because they helped transmit wisdom and knowledge to the younger generations. According to Professor Jared Diamond, the elderlyââ¬â¢s usefulness in a society plays a big part in determining their fate. The industrialization in the 19th century meant that aged were no longer useful since younger, faster and stronger workers were more desirable in the factory and the society. These negative attitudes continued up to the 20th and 21st centuries. People now can easily look up things in books, dictionary or on the Internet. They are no longer need to ask old people for their knowledge. Moreover, from the 1950s, the American culture was greatly affected by the youth. Many teen heroes such as James Dean were worshipped at that time (ââ¬Å"American Attitudesâ⬠, 2010). Slowly, the American culture started to shape as the culture of the youth and old people were left out of the picture. Different from the American, respect and caring toward old people seem to be the strength of Asian culture (Tom Plate, ââ¬Å"The Age of Insecurityâ⬠). According to a national survey in 2012, 75% of Vietnamese seniors live with their children. Most Vietnamese people take care of their parents until they die rather than sending them in to the nursing house like the Americans. Old people, regardless of wealth, education or social position, receive high respect in the society. This respect is expressed through attitude, behavior or choice of language. Itââ¬â¢s quite common to see a rich teenage boy shows his respect to the old street vendor lady by calling himself ââ¬Ëconââ¬â¢ (lower position) while addressing her ââ¬Ëdiââ¬â¢ or ââ¬Ëbacââ¬â¢ ( higher postion). The question here is why there is difference between the Vietnamese and Americans culture in the way they treat their seniors. Why in one country, they are respected and highly value but in another country, they are considered as the ââ¬Ëleft outââ¬â¢ part of the society? Perhaps the answer lies within the characteristic of the two cultures. In America, the emphasis are on independence, individualism and self-reliance so old people lose the respect of the society when they inevitable lose these traits. In contrast, since Vietnam culture is collectivism, it emphasizes on group-oriented values and social hierarchy. Therefore, young people are required to respect their parents, grandparents and their seniors. Moreover, most of the Americans have high demand on personal privacy (Judy Lin, ââ¬Å"Honor or abandonâ⬠). Hence, in America, children tend to move out and have their own home. In Vietnam, people donââ¬â¢t have such high demand for privacy. Even if they want privacy, the economic condition sometime doesnââ¬â¢t allow young Vietnamese to move out and live in their own house. Like it or not, some Vietnamese people are tied with their parents for live. Another reason for different attitude toward elderly between East and West is because in many collectivistic cultures like Vietnam, old people are seen as the sources of important knowledge such as culture or technology in the society. Young people, therefore, are expected to follow and learn from the older. However in America ââ¬â an individualistic culture, the role of the old is not highly valued since the young are encouraged to be independent, to express their own opinions and to seek knowledge by themselves. In addition, the stereotype and prejudice on old people are quite different in American and Vietnamese culture. In the US, old people are stereotyped as chronically ill, unable to work, behind the times, slow-thinking, useless financial burdens on society (ââ¬Å"American Attitudesâ⬠, 2010). In contrast, Vietnamese consider long life as a sign of kindness, knowledge and wisdom. Long life is a present from the deity for virtuous people (Huynh Dinh Te, Social relationships). We can easily recognize that in Vietnam, most of leaders of government or organizations are elderly while in America; people would prefer the young. In the 2008 election, many Americans debate that John McCain is too old to be the president. Unlike the American society that put a premium on youth, Vietnamese society is proud of its old members (Huynh Dinh Te, Social relationships). Americans should learn from Vietnam to respect and change their view on the elderly. Old people are not the burden of the society because they do contribute a lot. In fact, elderly people in Americans own 75 percent of all American assets. Almost all older men women are still productive. One-third of the old people in America still work for pay and one-third works as volunteers in churches, hospitals, and other organizations (John W. Rowe and Robert L. Kahn, ââ¬Å"Successful Agingâ⬠). In conclusion, Vietnamese and American view and treat their elderly differently due to many factors such as economy or characteristic of the culture. However, both cultures need to learn from each other in order to improve the lives of the old people. Poor health care and low living condition of course do no good to the elderly. However, old people also need more love, respect and caring from family rather the lonely life as a 5-stars nursing house. Age is a present, not a liability. Works Cited Paul Taylor. Trademark Act in India free essay sample
A reference to goods will imply services also, unless the context prohibits it. Trade Marks are at the centre of global business today. They are the major source of product differentiation and non-price competition in a modern, market driven economy. Consumers come to associate certain value in terms of performance, durability, price, after-sales service etc in the goods sold under specific brands, which may be among the greatest assets of the enterprise. In the language of the law, brand names are known as trade marks. Several products, of the same category or of different categories, can be marketed under one brand name. Recently, non-visual signs have made a strong claim for recognition as trade marks. Smell and sound signs fall under such category though they are not yet recognised in India. Several broadcasting organisations and film producers have specific signature tunes to identify their programmes. The concept of identifying the source of manufacture by a mark is an ancient one. We will write a custom essay sample on Trademark Act in India or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page Signatures of craftsmen have been found engraved on goods sent to Iran from India some 3000 years ago! But trade mark gained importance after the industrial revolution when large-scale production and istribution of goods all over the world became possible and publicity through print and audio-visual media became necessary. The use of modern trade mark as a distinctive sign to indicate the origin or source of the product, carrying with it an association of high quality, goes back to the eighteenth century England, as in the case of cutlery trade. The real boost to trade mark came with Unilever. It marketed its soap under the brand Sunlight, emphasising not the product as such but the brightness that its use will bring to the clothes cleaned with it. The similarity of the products in the same market has necessitated the marking of goods by a symbol, which could distinguish oneââ¬â¢s products from similar goods made by others. Trade Marks play a highly complex role in market driven economies, operating in the context of rapid integration of world economy. Through advertisement and other strategies, large market shares are captured by a few brands leading to concentration of market power in a few hands. If care is not exercised, a developing country may find itself flooded with foreign brands, unaccompanied by any flow of technology and 97 Awareness Course on Intellectual Property Rights uilding up of national capabilities. Of course, indigenous brands are exposed to severe and unequal competition in which they have to prove themselves. In 1940 the then British Government of India passed the Trade Marks Act for uniform and systematic registration of trade marks in India, which came into force on June 1, 1942. The Trade and Merch andise Marks Act, 1958, which came into effect from November 25, 1959, replaced it. It became necessary to effect changes in the trade mark law as India joined WTO as an original member in 1995 and it was obligatory to bring the Indian law in consonance with TRIPS. Hence new Trade Mark Act, 1999, repealed the old Act. The Act of 1999 makes important departures from the Act of 1958 in two important respects: â⬠¢ â⬠¢ Shape of goods is recognised as a trade mark; and Trade Marks are now granted for services also, besides goods. Goods is defined as anything which is the subject of trade or manufacture. Service means service of any description offered to users. Banking, finance, insurance, transport, energy supply, construction, hotels, entertainment, information and broadcasting etc. are all examples of areas where services are offered in connection with business, industry or commerce. Definition of service is meant to be all subsuming. The Registration of Trade Marks is done in Mumbai where the Trade Marks Registry is situated. There are branch offices of the Registry at Calcutta, Delhi and Chennai with separate jurisdictions. Objectives After studying this unit, you should be able to: â⬠¢ â⬠¢ â⬠¢ â⬠¢ â⬠¢ explain the meaning of trade mark; understand the philosophy of trade mark; distinguish between what kind of trade marks can be registered and what cannot be; explain the procedure for registration of trade mark; and highlight the characteristic features of Indian Trade Mark Law. . 2 WHAT IS A TRADE MARK? A trade mark, as currently recognised in India, is a visual symbol (in the form of a word, a name, a device, a symbol, or a label) which identifies any merchants or manufacturers goods or services and distinguishes them from similar goods or services of competitors in the trade. It may include shape of goods, their packaging and combination o f colours. The Act makes a distinction between a trade mark and a well-known trade mark. If a substantial segment of public associates a trade mark with a particular class of goods and services, and if this trade mark is used for other goods or services, and the public is inclined to associate the new goods/services with the earlier goods/services, then the mark is a well known trade mark. If the proprietor of a trade mark is an association of persons, who do not make a partnership within the meaning of the Indian Partnership Act, 1932, the trade mark is called a collective mark. A special class of trade marks is termed as certification trade marks. These trade marks do not indicate the origin of the goods, but are certified by the proprietor of the mark as conforming to certain characteristics, like quality, ingredients, geographical origin etc. Agmark used for food items in India is a certification mark. 98 A trade mark is a sign used on, or in connection with the marketing of goods. Saying that the sign is used on the goods means that it may appear not only on the goods themselves but also on the container or wrapper of the goods. Saying that the sign is used in connection with the marketing of the goods refers mainly to the appearance of the sign in advertisements (in newspaper, on television, etc. ) or in the windows of the shops in which the goods are sold. Where a trade mark is used in connection with services, it may be called service mark, e. g. service marks used by hotels, restaurants, airlines, tourist agencies. The worth of a trade mark may amount to huge sums. According to Business Week/Interbrandââ¬â¢s Annual Ranking of the 100 Best Global Brands, 2003, the value of the brand name Coca-Cola is estimated to be $70 billion and that of Nescafe $12 billion! A person who sells his product under a particular trade mark acquires an exclusive right to the use of the mark in relation to those goods. Such a right can be registered under the new Trade Mark Act 1999, which repealed the Trade Mark and Merchandise Marks Act 1958. A registered trade mark can be protected against unauthorised use by others by an action for infringement. An unregistered trade mark can also be protected against unauthorised use by others by an action of passing off.

Other areas of healthcare are also harming these countries.à Some of them involve malnutrition as well, while others involve poor sanitation.à It should be discussed that a look into a small subset of diseases is probably the best course in further assisting these poor nations. First, it is stated that if a child lives through childhood then the mothers in these nations will not have as many children.à This can be achieved by concentrating on a small grouping of diseases that are easily cured. Many people concentrate too much on every single affliction instead of realizing a bigger picture forms in these nations.à As the WHO reported ââ¬Å"the prospects of the poorest billion in the Third World can be radically improved by targeting a relatively small set of diseases and conditions.â⬠(Fogel Lee, 2002)à Many of the cures are easy to administer and should be universal for all members of the human race. Nutrition and other needs are considered to be the big killers among these populations.à The facts on Third World and Fourth World needs are staggering. The Commission on Macroeconomics and Health (CMH) of the World Health Organization estimates ââ¬Å"87 percent of deaths among children under age five, 71 percent of deaths between ages five and twenty-nine, and 47 percent of deaths between ages thirty and sixty-nineâ⬠can be eradicated by using existing drugs and vaccines, easily delivering food, and by public-health programs that promote positive sanitation and health. (Fogel Lee, 2002) The solutions to the problems seem easy to solve when a person thinks about the big diseases instead of every single problem facing Third and Fourth World countries. Learning and development in the workplace Essay
Learning and development in the workplace - Essay Example It has become a collaborated effort between the employer and the employee where they go through the learning process together so as to maximise the effects of the existing skills and competences. This paper will consider some flexible learning strategies that enhance the concept of workplace learning and development with short case studies as examples. Personal Development Plan Personal planning is approached by people differently based on the differences that individuals exhibit. Personal planning requires a great deal of individual effort for it to be effective. Not many people in the workplaces pay attention to developing personal plans despite being aware of their immense benefit toward personal development. In the workplace many employees feel that in developing a personal plan they are just but showing what the employer wants to see and term it as hypocritical or fail to see its value. Other employees who understand the benefits tend to take it pretty seriously. Personal develo pment plans are actually the efforts that one put in place aiming at tracking their education and performance paths. These plans assist an employee in developing their career path better. This plan includes events and benchmarks along a career path which may be long or short term depending on the goals to be achieved therein (Makinson 2001). This development plan usually encompasses learning as one works towards set goals and objectives. Personally I take a Personal Development Plan as an avenue through which am able to know myself better. A plan streamlines daily activities and compresses them within a specified timeframe. As such personal discipline is cultivated which enables one to easily surpass their initial targets on performance or even learning. PDP allows one to uncover their underlying strengths and weaknesses which in the past acted as major hindrances to efficiency and general performance at work (Rughani 2001). Personal development plans offer one a chance to evaluate performance in relation to the set targets. When this is done an individual employee is able to engage in corrective measures that include further training, acquiring of new skills while developing existing ones and acquisition of more knowledge and competence to perform various tasks at the workplace. A PDP outlines the timeframe within which achievements are to be made. As such one is able to know with certainty how far they have gone with the plan, how effective it has been and the timeframe left together with what remains pending (Cottrell 2003). This way an individual is able to analyse clearly the skills, knowledge and competences they have acquired and compare this with the set targets. One of the most important benefits of the PDP is the realisation of the skills and knowledge needed to attain unachieved objectives which in turn make an employee to develop themselves towards their attainment (Clifford & Thorpe 2007). Use of PDP is a sure way of identifying how one is learnin g and whether this process is bearing any fruits. It does that by offering evidence that is vital in analysing the required knowledge and skills in ultimately achieving particular objectives. This brings in the need for goals to follow the SMART model which stipulates that goals have to be Specific, Measurable, Achievable, Realistic and Time-based (Cottrell 2003). An individual following a laid out PDP needs to constantly evaluate the viability of their goals in respect to the elements of this model as failure to do so
